What is an H-1B labor condition application?

Before an employer can file an H-1B petition with USCIS, it has to file a labor condition application (LCA) with the U.S. Department of Labor stating the job, the worksite and the wage. The Department of Labor publishes every one. The counts here are certified LCAs, so they show which employers have gone through the first step for which jobs. One person can have more than one LCA, and some LCAs are never used, so treat the numbers as a picture of how often an employer does this, not a head count.

Does a filing mean a role will sponsor me?

No. A filing is a record of past hiring for some role, not a statement about any open role. Whether a given position can be sponsored is the employer's decision, case by case. Ask the recruiter early.

Which employers skip the H-1B lottery?

Universities and other institutions of higher education, nonprofits affiliated with them, and nonprofit or government research organizations are exempt from the annual H-1B cap, so their petitions are not in the lottery. We mark the universities we can identify from the filing data. National labs run by contractors vary, so check with the lab.

Why is an employer I know missing?

We show an employer only when it filed at least three LCAs in scientist and engineer occupations in the last four published quarters, and only when we can match the name it files under to the name on its job postings. A missing employer is not evidence that it never sponsors.

Which occupations are counted?

Chemists, materials scientists and engineers, chemical, mechanical, industrial, aerospace and biomedical engineers, physicists and other physical scientists, chemical technicians, R&D and engineering managers, and engineering, chemistry and physics faculty. Software, data, finance and medical occupations are left out, because an employer filing for software engineers says little about whether it files for a chemist.
